An affidavit is a written statement of facts that you swear or affirm to be true in the presence of a commissioner of oaths or notary public. Statutory declarations serve a similar purpose for matters that do not require court proceedings. These documents are commonly used for immigration applications, family law matters, property disputes, and various legal proceedings across Ontario.
Documents You'll Need
- Valid Government-Issued Photo ID ΓÇö Canadian passport, driver's licence, PR card, or provincial photo ID
- Draft of Your Affidavit or Declaration ΓÇö a typed or clearly handwritten statement of facts (we can help you draft one if needed)
- Supporting Documents ΓÇö any exhibits, contracts, correspondence, or records referenced in your statement
- Names and Details of All Parties ΓÇö full legal names, dates of birth, and addresses of individuals mentioned
Step-by-Step Process
- Submit your documents for review ΓÇö send us your draft affidavit and supporting documents via email or through our online form. We will review the content for completeness and legal formatting.
- Identity verification ΓÇö at the appointment, present your valid government-issued photo ID. The notary will verify your identity and confirm you are the person making the statement.
- Review and confirmation ΓÇö the notary reads through the affidavit with you to ensure all facts are accurate and you understand the contents of the document.
- Oath or affirmation ΓÇö you will either swear an oath (on a religious text) or make a solemn affirmation that the contents of your affidavit are true.
- Signing in the presence of the notary ΓÇö you sign the affidavit while the commissioner of oaths observes. The notary then signs, stamps, and seals the document.
- Receive your notarized document ΓÇö you receive the completed, notarized affidavit ready for submission to courts, government agencies, or other institutions.
Important: Never sign an affidavit before your appointment. The notary must witness your signature in person. Pre-signed documents cannot be notarized.
